• A And Y Explorers is not responsible for costs (for example; nonrefundable airlines tickets, visa expenses, etc.) cancelation of a trip caused by trip members, without consideration of what is the cancellation reason, or for any extra costs should the trip members have set out or returned before or after any planned date.
• A And Y Explorers is not responsible for any extra costs caused to any delay from the decision of trip participants. Extra unscheduled services are excluded from the overall cost and will be charged from member’s credit card.
• A And Y Explorers have the authority to cancel (as per the above conditions) or to change the tour dates because of such acts (for example war, terrorism, etc) or the forces of nature beyond the control of the explorers.
• Early Departures: No refunds will be given for members leaving a trip by personal decision, or by bearing of the guide. Participants will be responsible for any services that are out of the plan, for example, airline tickets costs.
• CHANGES: A And Y do not have the control on route changes due to nature forces. Route changes will dependably be at the responsibility of the guide. No refunds will be provided in case of any schedule change or route change.
• Delay: A And Y Explorers cant be in charge of any delay or Postponement in transportation at any time, however we are not responsible of any extra costs that may appear for any reason.
• Individual’s responsibilities: Trip individuals are in charge of the extra expenses. insurance, which includes crisis, emergencies, is recommended. Our Explorers is not responsible for loss, damage, theft or delayed delivery. But they will take care of your baggage and properties. A And Y Explorers acts as an agent for the accommodations transport, and services of the company supplying this trip.
• The client should buy trip insurance, if client isn''''''''''''''''''''''''''''''''t capable or willing to assume the risks, the client should purchase trip insurance.

ACKNOWLEDGMENT AND ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION

• In the attention given of the services provided by Lofoten Adventure, its shareholders, directors, officers, employees, agents, volunteers, participants and all other individual or entities associated with or acting in any capacity on its behalf, I hereby agree to release, compensate and discharge A And Y, on behalf of myself, my heirs, assigns, personal representative and estate and for all members of my family, including minor children, as follows:
• Even though A And Y has taken a way to provide suitable atmosphere and capable and skilled guides, and has been provided with all trip equipment’s, I acknowledge and agree that trekking, tours skiing/snowboarding, climbing and mountaineering, kayaking, cycling, caving, which may cause known and unforeseen dangers or risks that could result in physicalor emotional injury, damage, loss of motion, harm , property or potentially outsiders (third-parties).
• I comprehend that such dangers just can''''''''''''''''''''''''''''''''t be eliminated of without endangering the fundamental qualities of the activity. The risks include, among other things: the hazards of travelling in uneven terrain and slips and falls; being struck by rock fall, icefall or other objects dislodged or thrown from above; the use of climbing ropes and equipment, bicycles, kayaks, etc.; the forces of nature, including lightning, weather changes and avalanche; the risk of falling off the rock, mountain or into a crevasse; the risk of exposure to insect bites; the risk of altitude and cold including hypothermia, frostbite, acute mountain sickness, cerebral and pulmonary oedema; my own physical condition; and the physical exertion associated with this activity. Additional dangers may include the hazards of travelling in the Third World; accident or illness in remote places without access to emergency medical facilities; war, terrorism and other forces. I understand that this description of these risks is not complete and that other unexpected inherent risks may occur and happen.
• Furthermore, I acknowledge that A And Y seeks safety but is not infallible. It might be unaware of my or another participant’s fitness or abilities. It might misjudge the weather or other environmental conditions. It may give incomplete warnings or instructions and equipment being used might malfunction. I acknowledge that engaging in this activity may require a degree of skill and knowledge different than other activities and that I have responsibilities as a participant. I acknowledge that A And Y has been available to more fully explain to me the nature and physical demands of this activity and the risks, hazards, and dangers associated with this activity.
• I agree to assume all of the risks existing in this activity. I am satisfied to volunteer and participate in this activity in spite of all the risks.
• I acknowledge that A And Y and its guides have complete authority as to the performance of activities and trips and may modify itineraries, trip plans or cancel a trip for any reason. I acknowledge that the success of the trip depends on cooperation and collaboration of the participants with the trip guides and with each other. I accept the voluntarily submit to the authority of A And Y and its guides for the complete duration of the trip. Should a client act in anyway deemed by A And Y to be reckless, endangering his / her life or the lives of others in the trip; A And Y has the right to expel the client from the trip immediately with no refund.
• I hereby agree, forever with A And Y for any and all claims, demands or causes of action which are in any way connected with my participation in this activity including, but not limited to my use of A And Y Explorers equipment or facilities; my representations of my mental, health, fitness, and skill; and any claims which alleged negligent acts or omissions of A And Y Explorers.
• Any one from A And Y Explorers or anyone acting on their behalf will be required to incur attorney’s fees and costs to enforce this Agreement, I agree to reimburse them for all such fees and costs. (to be reviewed)
• I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the trip and I agree to be responsible on all the costs of such injury or damage myself should I not have adequate insurance. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
• I understand that A And Y may contract with third parties to provide services on the trip or activity, including transportation, travel services and guide services.
• I understand that A And Y has no responsibility for the actions of any independent contractor or third parties involved in providing services on the trip/activity.
• A And Y have the right and authority to document (written or photographic) any trips and participants, and use it for commercial and/or promotional goals.
